Intellectual Property is a cornerstone of Liquidia?s business strategy and the Patent Agent will contribute to the development and implementation of the existing and new intellectual property of the Company. The Patent Agent will work closely with the scientists and engineers of the Company, as well as in-house and outside legal counsel to identify and mature inventions into patent filings and issued patents. The Patent Agent will work under the direction of the Legal Counsel.
Duties and Responsibilities
Work closely with internal legal counsel on patent portfolio strategy, national and international patent prosecution, claim drafting, etc
Conduct inventor interviews and prepare and obtain documentation necessary to support patent filings
Draft, file and prosecute U.S. and foreign patent applications
Evaluate inventions for patenting
Oversee docketing together with in-house and outside legal counsel for due dates and other actions
Conduct prior art searches and evaluate prior art for patentability of new inventions and assist in survey and freedom-to-operate analysis, validity and non-infringement analysis
Apply patent knowledge to business issues, develops subject matter expertise and in-depth knowledge of the multiple areas of technical interest of the company
Train engineers and scientists in patent law and procedures
Some trademark docket overview and searching
Assists in contract management, agreement tracking and due diligence assignments
Prepare and review standard CDA and MTA agreements
Work closely with and manage University relationship, including: technical and intellectual property development, publication requests and review; and contract management
All other duties as assigned
Patent Agent with 5 years of direct experience in patent application preparation, filing and prosecution required. USPTO Registration Number is required
Advanced degree in a technical discipline; Chemical Engineering, Chemistry, Biotechnology, Pharmaceutical sciences, Biological science, Biomedical Engineering, or equivalent required
Individual must be flexible, high energy and receptive to taking on new, multi-disciplinary projects on short notice
Proven ability to efficiently and independently prepare, file and prosecute U.S. and foreign patent applications
Thorough knowledge of U.S. patent law as applied to patent prosecution required. Exposure to International and foreign patent law preferred
Experience working in a law firm preferred
Experience working in a biotechnology, pharmaceutical or nanotechnology company preferred
Requires aptitude to learn about new areas of technology outside core area of expertise
Experience with routine contracts (CDAs, MTAs) preferred
Strong IP strategy and business acumen
Excellent interpersonal verbal and written English communication skills
Must enjoy working in a fast-paced environment and have the ability to prioritize projects, set stakeholder expectations, and plan for deadlines
