Manage contested foreclosure and bankruptcy cases. Attend court appearances, trials, etc. Monitor the attorney and vendor?s progress; provide essential tools and feedback to insure timely and accurate processing in accordance to investor, insurer and EverHome Mortgage standards. Provide direction, training, and assistance to Default Outsourcing and Escalation teams.
? Manage contested foreclosure and bankruptcy cases.
? Coordinate with Sr. Management, Corporate Legal and attorneys for decision and resolution.
? Attend various court appearances, hearings, trials, etc. representing EverHome/EverBank.
? Complete research and respond to various legal documents (i.e., interrogatories, discovery/evidentiary, etc.)
? Monitor Outsourcer?s performance via Foreclosure/Bankruptcy report writers and Passport.
? Prepare extensive detailed loss analysis to management, investor, etc.
? Prepare rebuttal to prior servicer, investor, etc. for repurchase demands.
? Coordinate and orchestrate settlement negotiations through to resolution.
? Provide Outsourcer?s management with exception report to assist with processing.
? Ensure functions performed internally by the default outsourcing team are completed timely and accurately.
? Assist other default managers in resolving issues with the vendor.
? Review potential loss and / or high risk default items. Analyze and provide recommended solutions to senior management for decisions and best courses of action.
? Minimize default losses through aggressive timeline management and resolution of loan level delays or procedural issues.
? Coordinate receipt of acquisition files, review, and coordinate mapping of data. Forward file to appropriate department at Outsourcer?s shop.
? Follow up with prior servicer for missing files, documentation, etc.
? Bill prior servicer for losses related to any monetary errors that may have occurred prior to transfer.
? Work with EverHome?s Year End Committee to insure correct reporting of 1099MISC information to the IRS.
? Audit files that are in process at Outsourcer to determine if processing is accurate and timely.
? Coordinate audits with investors when necessary.
? Assist with the Due Diligence review on future acquisitions.
? Update and maintain MERS reporting as it pertains to foreclosure.
? Provide training and assistance to team.
? Maintain data integrity on Database.
Minimum Qualifications (Knowledge, Skills and Abilities)
? Ability to work with little or no supervision.
? Must be able to resolve conflicts in a professional and courteous manner.
? Must feel at ease working with Sr. Management.
? Must work well under stressful situations.
? Minimum of five years of Legal background or experience, including court appearances.
? Prior supervisory or leadership experience preferred.
? Excellent verbal and written communication skills.
? Ability to foster productive relationships with outsource vendors.
? Comfortable analyzing situations and providing recommendations.
? Must be a proactive and able to prioritize.
? Rely on one?s own ability to research and resolve problems.
? Be a self starter and reliable.
? Must be able to keep confidential information to oneself.
? Travel requirements.
? Negotiation or settlement proceedings.
? Minimum of two to three years of Default Servicing and GSE guidelines.
Training and Experience
? High School degree.
? College education a plus.
? Have extensive knowledge of Fidelity?s MSP system.
? Have knowledge of Word, Excel, Passport, Crystal and Access.
? Some accounting background helpful.
